We offer an initial telephone discussion to establish the nature of the dispute, whether there is any conflict of interest that would prevent us from acting and to identify what documents you will need to send us. Our first concern will be advising you so you can make an informed commercial decision on the best way forward, including any costs proportionality issues and you being satisfied your opponent is in a financial to settle any liability to you. We will always consider alternative methods of settling disputes (ADR) tailored to your business and your commercial objectives.

For example, if the best way forward is to retrieve a valuable commercial relationship with the opposing party, we may suggest mediation or another ADR initiative to achieve this. We consider all the options for funding your legal fees too, from paying us on an hourly rate, a fixed fee for agreed work, or in some cases insurance or “no win no fee agreements”. We will work with our clients and – where appropriate – carefully chosen consultancies, experts and Counsel to present your case to the best possible advantage at every stage.

Almshouse Charities

Gullands regularly acts for Trustees of Almshouse Charities across the whole of England providing advice on how best to deal with residents in a whole range of situations and specifically advice where consideration is being given by Trustees whether to set aside the appointment of a resident as a Beneficiary of a Charity. These situations include disruptive behaviour, disputes with other Beneficiaries, no longer being capable of independent living and a failure to pay Weekly Maintenance Contributions. These cases need to be handled with expert knowledge decisively and sensitively. Philip Grylls acted for the Trustees of the Ashtead United Charity (Stewart v Watts and others  [2016] EWCA Civ 1247) in the last case to go to the Court of Appeal on the issue of the status of almshouse residents and the Court upheld the Trustees’ decisions.
